Dinamika Hukum Islam Indonesia : Reaktualisasi Norma Islam dalam Menalarkan Hukum Positif Merespon Sosio-Kultural Era Kontemporer
Abstract
Perubahan sosial yang terjadi di era kontemporer mengakibatkan hukum Islam perlu merespon secara dinamis. Hal ini mengingat ajaran Islam yang bersifat inklusif tidak boleh tertutup dengan perkembangan zaman. Aktualisasi ajaran Islam perlu dilakukan agar dapat mengakomodir perubahan sosio-kultural di era kontemporer yang tetap relevan dengan pedoman Al-quran dan Al-Hadist. Penulisan artikel ini bertujuan untuk mengetahui, memahami, dan menganalisis bagaimana pengaruh sosio-kultur terhadap aktualisasi hukum Islam Indonesia di era kontemporer. Penulisan artikel ini menggunakan metode penelitian normatif dengan menelaah segala sumber bahan pustaka sebagai bahan primer untuk menganalisis isu yang menjadi topik kajian. Pendekatan penelitian dalam penulisan artikel ini menggunakan content analysis berdasarkan korelasi isi sumber bahan yang selaras dengan problematika isu kajian. Hasil penulisan artikel menunjukkan aktualisasi hukum Islam di Indonesia sebenarnya sudah pernah diterapkan di masa lampau. Akan tetapi di era komtemporer saat ini, aktualisasi Hukum Islam tidak boleh berhenti. Revolusi Industri 4.0 sebagai faktor utama telah mempengaruhi dinamika sosio-kultural dari segi Ekonomi, Sosial, Budaya, Moral, teknologi yang semakin modern. Perlu upaya reaktualisasi ajaran islam yang relevan dalam merespon perkembangan faktor tersebut mengingat hukum Islam yang tersedia belum tentu mengakomodir problematika terkini. Hasil reaktualisasi ajaran Islam memiliki urgensi bagi positivisasi hukum di Indonesia terutama dalam mengatur tata prilaku umat di era kontemporer yang tidak keluar dari koridor tatanan Islam.
