Keabsahan Perkawinan Hukum Adat Lombok (Merarik) Ditinjau dari Perspektif Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Hukum Islam (Studi di Kabupaten Lombok Tengah)
Abstract
Merarik merupakan perkawinan suku adat Sasak yang kaya dengan nilai-nilai budaya dan merupakan kearifan lokal yang dimiliki masyarakat suku Sasak. Merarik dalam suku Sasak adalah membawa lari calon pengantin perempuan oleh calon pengantin lelaki ke tempat keluarga si lelaki untuk disembunyikan dengan tujuan supaya dapat dinikahi dan dijadikan istri. Perkawinan hukum adat Lombok (Merarik) dalam perspektif UU No. 1 Tahun 1974 tentang Perkawinan dan Hukum Islam adalah sah baik secara hukum positif dan hukum Islam karena perkawinan Merarik proses adat-istiadatnya saja yang berbeda, sedangkan yang lainnya sama baik mengikuti ketentuan UU No. 1 Tahun 1974 tentang Perkawinan maupun syarat-syarat yang terdapat dalam hukum Islam.
Merarik is a marriage of indigenous Sasak tribe that is rich with cultural values and merarik is a local wisdom owned by the Sasak tribe community. Merarik in the Sasak tribe is bringing the bride ran by the bridegroom to the man's family to be hidden in order to be married and made wife. The marriage of the customary law of Lombok (Merarik) in the perspective of Law no. 1 of 1974 on Marriage and Islamic Law is lawful both positive and Islamic law Because marriage Merarik process of customs are different, while others are equally well following the provisions of Law no. 1 Year 1974 on Marriage and the conditions contained in Islamic law.
